Jane Jarman, professor at Nottingham Law School, will present the case for a change in the definition of legal professional privilege (LPP) in s87 of the Trade Marks Act 1994.
Jane will lay out the aspects of the statutory nature of LPP which may no longer be aligned with how attorneys work today, and investigate the danger of conflating common law privilege with statutory privilege, the boundaries of application for which are often unclear.
Additionally, Jane will explore the effects of the definition of LPP for attorneys predating the Legal Services Act 2007, and how the current definition of LPP could be updated to clarify the market between attorneys and solicitors when providing similar services.
You will also benefit from a review of the development of LPP for attorneys and the case law that underpins its evolution.
Finally, Jane will offer a brief rundown on the new IPReg code of conduct.
The lecture will be followed by a drinks reception, kindly hosted by Potter Clarkson.
The lecture supports skill set: 1.2 Adversarial proceedings of the Advanced Competency Framework.
