The Higher Courts Litigation Certificate allows you to expand your IP litigation practice and expertise to be able to conduct litigation in Courts other than IPEC.

How is the Higher Courts Litigation Certificate achieved?

By attending and passing Nottingham Law School’s (NLS) IP Litigation Course. NLS is the sole IPReg accredited provider of this course.

The Certificate in IP Litigation course is designed for:

  • Patent Attorneys and Trade Mark Attorneys
  • enabling attendees to apply their knowledge and skills to their own professional practice
  • continuing professional education.

The course is delivered to suit busy schedules and minimise time spent away from the office. The course will enhance:

  • case analysis skills;
  • drafting skills;
  • knowledge of the law of evidence and related practice;
  • your management of litigation procedure in the civil courts;
  • your experience of methods of dispute resolution other than litigation;
  • your development of the skill of reflective practice.

The NLS IP Litigation course is operated under the supervision of IPReg.

The content of the substantive subject and skills is drafted by Nottingham Law School and approved and accredited by IPReg.

The tuition, together with the form and content of the assessment regime, is monitored rigorously by internal and external examiners.

What happens during the course?

You will attend NLS four times during the academic year.

This is a practical course where you will work together in fictitious firms in between and during the modules allowing you to “learn by doing”, facilitated by litigation practitioner tutors.

The three-day modules (Thursday-Saturday) are delivered in November, February and April with a four-day module in June. Assessments comprise a written three-hour paper and an advocacy assessment and take place in May and June respectively.

The teaching style at NTU was friendly and informal but very professional throughout. The tutors were all very approachable and had a deep knowledge of their area.

What litigation rights does the IPReg Higher Courts Litigation Certificate give you?

  1. All rights given under an Intellectual Property Litigation Certificate;
  2. A right of audience to appear before the County Court when the court is hearing a matter where Part 63 of the Civil Procedure Rules apply or any matters ancillary thereto;
  3. A right to conduct litigation and a right of audience to appear in case management conferences and in interim proceedings before:

a) the Patents Court; and

b) in any other Court of the High Court when the court is hearing a matter where Part 63 of the Civil Procedure Rules apply or any matters ancillary thereto; and

  1. A right to conduct appeals from decisions in proceedings mentioned in paragraph (iii) to the Court of Appeal and the Supreme Court
