EUIPO launches mediation centre
The EUIPO has launched a new mediation centre for alternative dispute resolution (ADR).
The centre, which became available to users on 22nd November, will provide access to ADR guidance for IP disputes free of charge.
The ADR services are currently offered to anyone involved in inter partes proceedings at second instance before the EUIPO, helping to avoid time-consuming and expensive litigation.
A range of support services will be offered through the centre, including:
- Mediation
- Conciliation
- Expert determination.
During 2024 and 2025, the centre will also be developed to allow all users access to ADR for first instance proceedings. Initially, SMEs will be able to request access to support in this area before it becomes universally available.
João Negrão, Executive Director of the EUIPO, said:
“The establishment of Mediation Centre is a major step in supporting citizens and businesses in managing their intellectual property rights effectively and helping avoid expensive, unpredictable litigation processes when disputes arise.
“With 42% of EU trade mark applications coming from non-EU companies, cross-border disputes have become more and more common, highlighting the need for global and cost-effective dispute resolution services.”
The mediation centre will be delivered through an online platform.
However, in addition to virtual interaction, meeting space will be available at the EUIPO headquarters in Alicante or, for an extra charge, in Brussels.
The ADR services will be conducted by an EUIPO-appointed mediator. At present, services are available in the Office’s five languages: English, French, Spanish, German and Italian.
